(f) In cases involving involuntary manslaughter in which the victim was a family or household member as defined in paragraph (3) of Section 112A-3 of the Code of Criminal Procedure of 1963, the penalty shall be a Class 2 felony, for which a person if sentenced to a term of imprisonment, shall be sentenced to a term of not less than 3 years and not more than 14 years.

Another case of Lack of Proper Actions by Prosecutors in Kane County
Here we go again! As reported previously above this subject has violated his release protocol more than twice after his arrest for involvement in the Halloween accident that claimed the lives of a local brother and sister and severely injured another passenger. In today’s hearing regarding the violations, the prosecutors went into a closed meeting to discuss a “plea deal” and no judgement was taken regarding the violations! After multiple instances of violations including two more traffic violations. Is the complete Judicial System in Kane County just missing the bar? How does this reflect back on the victims that lives were lost, damaged, and destroyed.
ISLAND LAKE MAN SENTENCED TO SIX YEARS FOR DRUG-INDUCED HOMICIDE RE: Daniel R. Carmody: Age 48 (d.o.b. 08-13-1976), of the 100 block of Southern Terrace, Island Lake, Illinois. Case No. 2021CF1584. St. Charles, Ill. - Kane County State’s Attorney Jamie L. Mosser announces that Daniel R. Carmody has agreed to a sentence of six years of imprisonment in the Illinois Department of Corrections in exchange for a guilty plea to the offense of drug-induced homicide, a class X felony. Judge D.J. Tegeler accepted the plea. Assistant State’s Attorney Kelly Orland stated in court that on or around May 10, 2021, Carmody unlawfully delivered heroin and cocaine to the victim, 31-year-old Daniel Liewald of St. Charles. Liewald ingested the substances. He was found to have died from fentanyl and cocaine intoxication.
October 10, 2019 A Carpentersville man will go to prison for possessing cocaine he planned to deliver. 52-year-old Lamelle T. Johnson today agreed to a sentence of 11 years’ imprisonment in the Illinois Department of Corrections in exchange for a guilty plea to the offense of unlawful possession of a controlled substance with intent to deliver, Class X felony. Kane County Circuit Judge John A. Barsanti accepted the plea. Kane County Assistant State’s Attorney Mark D. Stajdohar stated in court that at about 4:45 p.m. Nov. 2, 2018, Carpentersville police served a search warrant at Johnson’s residence in the 1100 block of Chippewa Circle, Carpentersville. Johnson saw the officers approach his home and closed and locked his door. When officers entered Johnson’s home, they found him in his bedroom shoving cocaine into his mouth. As an officer approached him, Johnson threw cocaine in the officer’s face. Officers found in Johnson’s home just less than 28 grams of cocaine with an estimated street value of $2,790, three digital scales with cocaine residue, and $8,148 in cash.
WAUKEGAN, IL — The Lake County State's Attorney's Office presented false and misleading evidence from a state police investigator to a grand jury in order to secure an indictment against the Waukegan City Clerk, according to a judge's bombshell order issued Friday.
Lake County Circuit Judge Patricia Fix dismissed all criminal charges against City Clerk Janet Kilkelly, ruling that grand jurors likely would not have indicted her in the first place had Illinois State Police Special Agent Dave Juergensen testified truthfully.
"Police and prosecutors’ roles are intertwined with both bearing reciprocally weighty responsibilities to uncover and analyze all relevant facts and evidence upon reviewing charges and requesting indictments," Fix said in the order.
